TERMS & CONDITIONS FOR “ON-PREMISE KEY ACCOUNT SHARE-A-COKE” PROMOTION
(the “Promotion”)

IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (“TERMS AND CONDITIONS”) BEFORE ENTERING THIS PROMOTION. THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND COCA-COLA REFRESHMENTS MALAYSIA SDN. BHD. (“PROMOTER”) ESTABLISHING THE TERMS AND CONDITIONS UNDER WHICH YOU ARE ENTITLED TO PARTICIPATE IN THIS PROMOTION. BY ENTERING THIS PROMOTION, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO ABIDE BY THESE TERMS AND CONDITIONS.

A. Eligibility

  1. The Promotion starts from 00:00hrs on 1 May 2025 and ends at 23:59hrs on 31 July 2025 (“Promotion Period”), unless the Collectibles (as defined below) have been fully redeemed before the end date.

 

  1. Any entry received outside of the Promotion Period shall be automatically disqualified from participation. The Promoter is not liable for any lost, delayed, or misdirected Entries (as defined in paragraph C.1, C.2 and C.3 below).
B. Promotion Period
  1. The Promotion starts from 00:00hrs on 1 May 2025 and ends at 23:59hrs on 31 July 2025 (“Promotion Period”), unless the Collectibles (as defined below) have been fully redeemed before the end date.

  2. Any entry received outside of the Promotion Period shall be automatically disqualified from participation. The Promoter is not liable for any lost, delayed, or misdirected Entries (as defined in paragraph C.1, C.2 and C.3 below).

C. How To Participate

  1. Purchase a minimum of 2 combo meal which includes beverages from any of the Participating Brands in a single receipt (“Proof of Purchase”) from any on-premise chain restaurants, cinemas, theme parks, and food delivery (e.g. Subway, Burger King, Kenny Rogers, Nando’s, Sugarbun & Pezzo PM, TGV Cinemas and this list is non-exhaustive) that carries the products from the Participating Brands, and which displays the Promotion’s point of sales material (“Participating Store”) during the Promotion Period. You are advised to keep the original Proof of Purchase for record and/or verification purposes.

 

  1. To participate, Participants are required to either (i) scan the QR Code printed on the in-store point of sale materials, or (ii) access the Promotion website at https://opka.lavish-site.com/my-dashboard//.

 

  1. The Participant would then be directed to a landing page where the Participant is required to provide his/her name, contact number, email address, delivery address, and to submit a photo of the Proof of Purchase (each an “Entry” or collectively “Entries”).

 

  1. Participating Brands are: “Coca-Cola Classic”, “Coca-Cola Rasa Asli”, “Coca-Cola Zero Sugar”, “Coca-Cola Vanilla”, “A&W”, “Sprite”, “Fanta”, “Fuze Tea”, “Minute Maid”, “Authentic Tea House”, “Glaceau Vitamin Water” and “Schweppes”.

 

  1. For each eligible combo purchased, the Participant is eligible to receive one (1) point (“Point”), i.e. one (1) combo with product from Participating Brands = one (1) point for redemption of collectibles.

 

  1. Points can be accumulated to redeem collectibles.

  1. Collectibles are available on an as-is basis and are not transferable, exchangeable, or converted to monetary value. Collectibles are also on ‘while stocks last’ basis. In the event your selected collectible is no longer available, the Promoter reserves the right not to award any collectible or any alternative collectible of equal or greater value, for any reason whatsoever to any person who fails to meet any stipulated requirement in order to claim the collectible.

 

  1. Phone data usage to participate in this Promotion may be subject to charges by your service provider / carrier which shall be borne by the Participant.

 

  1. Each Entry shall be subject to verification by the Promoter and / or its representatives. In the event that details are invalid as determined at the Promoter’s sole discretion, the Entry will be disqualified.

 

  1. Personal information (including images) collected or received from the Participants may be used by the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch), and/or their respective agents and agencies for the purposes of administering the Promo, including conducting a background check on the Participant’s identity, and verifying their eligibility to participate and receive a collectible. By participating in the Promo, the Participant explicitly allows the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and/or their respective agents and agencies to contact the Participant via the Participant’s particulars provided for such purpose. The Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their respective agents and agencies values all personal information received and shall not disclose or furnish the Participant’s personal information to any unrelated third parties (save for their respective agents and agencies for the purposes of this Promotion or where required by law). The Promoter shall manage all personal information collected, which contains personal data, according to the Personal Data Protection Act 2010.

 

  1. Any Entry that is incomplete, missing the Proof of Purchase, illegible, mutilated, altered, duplicated, tampered with, not obtained legitimately, or which contains printing, typographical, mechanical, or other errors will be disqualified.

 

  1. All Entries (including the Proofs of Purchase) submitted shall become the property of the Promoter and will not be returned.

 

  1. Multiple entries are permitted. However, each Entry must be supported by a different Proof of Purchase (i.e. a Proof of Purchase is valid for one (1) Entry only). In the event of multiple qualifying purchases in one Proof of Purchase, it shall be considered as one Entry.

 

  1. Unless otherwise specified, all redemption MUST be completed by 31 July 2025. Points not redeemed by the stipulated date will be forfeited.

 

  1. Collectibles are subject to the terms and conditions of the respective sponsors and third-party vendors, if any. The Promoter is not liable for these conditions and the use of the Collectibles.

 

  1. The Promoter shall not be liable for warranties, maintenance, taxes or any additional costs associated with the Collectibles. Collectibles will be delivered in Malaysia only.

 

  1. The use of any voting software or any other mechanical or electronic means that enable you to automatically send codes or entries repeatedly is prohibited and will render all codes submitted by you invalid. The Promoter reserves the right to take action as may be available under the law against you.

 

  1. Each participant can redeem up to a maximum of 10 units of each Collectibles.

D. Other Conditions

  1. All promotional materials shall form part of these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions with any advertising, promotional or publicity materials in relation to or in connection with the Promotion, these Terms and Conditions shall prevail.

 

  1. The Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd. and/or Coca-Cola Far East Limited (Malaysia Branch), are not and shall not be held responsible for any delay, error or any other problems in the operation of the Promotion caused by or arising from breakdown, technical malfunction of any telephone network or lines, computer or on-line-systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems and / or traffic congestion on the internet and / or at any website or the telecommunication service or a combination thereof, including injury or damage to any participants or to any other person’s computer or mobile phone related to and / or resulting from participating or downloading materials in or in connection with the Promotion.

 

  1. In no event will the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch), and their respective parents, affiliates, subsidiaries and related companies, their respective advertising or Promotion agencies or their respective officers, directors, employees, members, shareholders, attorneys, respective and agents (collectively, “Affiliates”), be responsible or liable for any damages or losses of any kind, including but not limited to direct, indirect, incidental, consequential, special or punitive damages arising out of any the Participant’s acceptance of the Collectibles, or their participation in the Promotion. By participating in the Promotion, Participants hereby release and agree to hold harmless the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their Affiliates from and against any and all rights, demands, claims, cause of action, losses, damages, costs and expenses whatsoever that they may have, or which may arise, whether in whole or in part, and whether directly or indirectly.

 

  1. The Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their Affiliates make no warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability or fitness for a particular purpose of any of the Collectibles. Without limiting the generality of the foregoing or anything in these Terms and Conditions, the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their Affiliates are not liable for any defect in the Collectibles. For the avoidance of doubt, no provision in these Terms and Conditions shall be construed as limiting the liability of any party for death or personal injury caused by such party’s negligence or any liability which cannot be excluded under the laws of Malaysia.

 

  1. Notwithstanding any of the foregoing, the Promoter reserves the right to amend, add, replace, vary and / or modify these Terms and Conditions without giving prior notice. By participating in the Promotion, the Participant is deemed to have accepted this Terms and Conditions and any amendments, additions, replacements, variations and modifications hereto, which shall be final and binding in all respects.

 

  1. This Promotion and the Terms and Conditions shall be governed by the laws of Malaysia. The parties hereby submit to the exclusive jurisdictions of the courts in Malaysia.

 

  1. The Promoter’s decision on all matters relating to the Promotion is final, conclusive, and binding. No correspondence will be entertained.

  1. For each Product purchased, the participant is eligible to receive one (1) stamp (“Stamp”), i.e., one (1) participating product purchased = one (1) stamp onto your E-Form.

  1. The Redeemable Collectibles are available on an as-is basis and are not transferable, exchangeable, or converted to monetary value. Collectibles are also on ‘while stocks last’ basis. In the event your selected collectible is no longer available, the Promoter reserves the right not to award any collectible or any alternative collectible of equal or greater value, for any reason whatsoever to any person who fails to meet any stipulated requirement in order to claim the collectible.
  1. The Redeemable Collectibles are subject to terms and conditions of the respective sponsor and third-party vendors, if any. The Promoter is not liable for these conditions and the use of these Redeemable Collectibles.
  1. Participants are required to scan the promotion QR CODE or enter via https://opka.lavish-site.com as printed on the Promotion in-store Point of Sale materials. Follow the steps thereafter from the redemption website.
  1. Participants would then be required to either Log-in via their existing Google or Facebook account or create an independent login account on the promotion microsite.
  1. All costs and expenses incurred and/or arising from the participation in the Promotion, including without limitation, telecommunications, network, Short Messaging Services, postal and all such other charges and out-of-pocket expenses as may be incurred by a Participant during or in connection with the Promotion shall be borne by the Participant.
  1. Each Entry shall be subject to verification by the Promoter and / or its representatives. In the event that details are invalid as determined by the Promoter’s sole discretion, the entry will be disqualified.
  1. Personal information (including images) collected or received from the Participants may be used by the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch), and/or their respective agents and agencies for the purposes of administering the Promotion, including conducting background check on the Participant’s identity and verifying their eligibility to participate and receive a Collectibles. By participating in the Promotion, the Participant explicitly allows the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and/or their respective agents and agencies to contact the Participant via the Participant’s particulars provided for such purpose. The Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their respective agencies values all personal information received and shall not disclose or furnish the Participant’s personal information to any unrelated third parties (save for their respective agents and agencies for the purposes of this Promotion or where required by law). The Promoter shall manage all personal information collected, which contains personal data, according to the Personal Data Protection Act 2010.
  1. Entry that is illegible, mutilated, altered, duplicated, tampered with, not obtained legitimately, contains printing typographical, mechanical or other errors or the printing are unclear or does not contain information or proof purchase required in the Participant Form is invalid.

    D. Verification

 

  1. Entries submitted are subject to verification.   2. All Entries (including the Proofs of Purchase) submitted become the property of the Promoter and will not be returned.

    E. Other Conditions

 

  1. All promotional materials, including details on How to Participate and Redeemable the Collectible form part of these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions with any advertising, promotional or publicity materials in relation to or in connection with the Promotion, these Terms and Conditions shall prevail.
  1. The Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd. and/or Coca-Cola Far East Limited (Malaysia Branch), are not and shall not be held responsible for any delay, error or any other problems in the operation of the Promotion caused by or arising from breakdown, technical malfunction of any telephone network or lines, computer or on-line-systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems and / or traffic congestion on the internet and / or at any website or the telecommunication service or a combination thereof, including injury or damage to any participants or to any other person’s computer or mobile phone related to and / or resulting from participating or downloading materials in or in connection with the Promotion.
  1. In no event will the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch), and their respective parents, affiliates, subsidiaries and related companies, their respective advertising or promotion agencies or their respective officers, directors, employees, members, shareholders, attorneys, respective and agents (collectively, “Affiliates”), be responsible or liable for any damages or losses of any kind, including but not limited to direct, indirect, incidental, consequential, special or punitive damages arising out of any the Participant’s acceptance of the Redeemable Collectibles (if selected as winner), or their entry into the Promotion. By entering into the Promotion, participants hereby release and agree to hold harmless the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their Affiliates from and against any and all rights, demands, claims, cause of action, losses, damages, costs and expenses whatsoever that they may have, or which may arise, whether in whole or in part, and whether directly or indirectly.
  1. The Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch)and their Affiliates make no warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability or fitness for a particular purpose of any of the Redeemable Collectibles. Without limiting the generality of the foregoing or anything in these Terms and Conditions, the Promoter, Coca-Cola Bottlers (Malaysia) Sdn. Bhd., Coca-Cola Far East Limited (Malaysia Branch) and their Affiliates are not liable for any defect in the Redeemable Collectibles. For the avoidance of doubt, no provision in these Terms and Conditions shall be construed as limiting the liability of any party for death or personal injury caused by such party’s negligence or any liability which cannot be excluded under the laws of Malaysia.
  1. Notwithstanding any of the foregoing, the Promoter reserves the right to amend, add, replace, vary and / or modify these Terms and Conditions without giving prior notice. Entry into this Promotion confirms acceptance of these Terms and Conditions and any amendments, additions, replacements, variations and modifications hereto, which shall be final and binding in all respects.
  1. This Promotion and the Terms and Conditions shall be governed by the laws of Malaysia. The parties herby submit to the exclusive jurisdictions of the courts in Malaysia.
